OOL AND TENNIS FACILITIES POLICY

Premise: The pools and tennis facilities are for exclusive use of BHOA members and guests. We assess our members to cover the operative cost of the facilities, and limit use of the facilities to those who are current with their financial obligations.

To limit the use of our facilities to members and guests, and keep the access and monitoring as user friendly as possible, a card system to monitor member access, and combination locks to keep the workers and other non-members out, will be employed.

Our security guards will regularly monitor the facilities to ensure users have required access cards.
Lock codes will be issued as follows:
1. - Annual dues payers code issued for 1 year
2. - Monthly dues payer code issued for 1 month. *(1)
3. - Renters code issued for term of rental. *(2)

The lock code is only to get into the facility; the RECREATIONAL ACCESS CARD authorizes use of the facility. Access cards will be issued to all members in good standing for either 1 year or 1 month depending on how the dues are paid. Renter’s cards will be available at BHOA office to be issued to the renter or given to the owner or rental agent.

*(1) Monthly codes while available at BHOA office may be sent via the Internet. Access cards will be available at the BHOA office for members and guests.

*(2) Renters will be considered guests of the owner. The owner or rental agent must complete a “renters use agreement”, which will include the owners name and address, length of renters stay, number of persons using the residence, and a statement that the owner or agent agrees to take responsibility for the actions of the renters. The BHOA will issue a lock code and access card to those who have completed the above, as long as the property involved is current with their financial obligations. An application fee of $25.00 USD will be charged for each access card. The card will be valid for the entire length of the renters stay.

Placards outlining general rules of conduct and use will be posted in each facility. Security will ask violators to leave the facility. A notice similar to the following will be posted in each facility.

The Bajamar Home Owners Association (BHOA) requires all members, guests, and renters using its facilities possess a valid card. The owner or agent of the home where you are staying should have provided a card to you. You are required to have that card with you while using the facilities. You must leave this facility if you do not have a valid access card.

PPENDEX A. Swimming Pool.

UNLESS OTHERWISE NOTED A FINE OF $25.00 USD PER OCCURRENCE, MAY BE APPLIED, AND OR EXPULSION FROM THE FACILITY.

1. BHOA access card is required to be in users possession.
2. Members must accompany and stay with their guest or guests must have a GUEST PASS.
3. No property may have more than six (6) people using the pool at one time.
4. Persons under 14 years of age must be accompanied by an adult (18) years of age or older. All swimmers are encouraged to use the buddy system.
5. No glass containers or objects are allowed in the pool area.
6. No running, pushing or throwing allowed in the pool area.
7. No bikes, skateboards, roller-skates / blades, or pets allowed in the pool area.
8. Notify security immediately in the event of an incident, accident, or emergency.
9. Proper swimwear must be worn; all babies and toddlers must wear swim pants in the water.
10. Toddlers and babies must not wander around the deck or sit on the edge of the pool unless accompanied by an adult.
11. An adult who is an experienced swimmer must accompany any individual using water wings or other flotation device.
12. MEMBERS AND GUESTS USE THE POOL AT THEIR OWN RISK. NO LIFEGUARD IS ON DUTY.

APPENDEX B. Tennis Courts.

UNLESS OTHERWISE NOTED A FINE OF $25.00 USD PER OCCURRENCE, MAY BE APPLIED, AND OR EXPULSION FROM THE FACILITY.

1. No persons other than actual players and maintenance personnel are allowed on the courts.
2. Tennis shoes with non-scoffing soles must be worn on the courts at all times.
3. Players are encouraged to wear appropriate tennis apparel while on the courts.
4. Nothing other than tennis related equipment is allowed on the courts. No bicycles, skateboards, roller or in-line skates are allowed on the courts.
5. When other players are waiting, play is limited to 2 (two) sets for doubles and one (one) set for singles. –For these purposes, a set is defined as no more than 12 (twelve) games.

OWNER / AGENT AGREEMENT

I certify that I am the owner or authorized rental agent for the above property, and I agree to take full responsibility for the actions of the renters of this property. I will instruct the renters in the use of the facilities as stated en the facility use policy (appendix A & B attached) and the BHOA policies regarding parking, noise and conduct. I may be contacted by a representative of the BHOA o resolve any issues that may arise.

BAJAMAR GUEST POLICY


THANK YOU FOR YOUR COOPERATION

Welcome: we hope you enjoy your stay and will want to come back in the future. Homeowners, renters and guests must comply with the BAJAMAR HOME OWNERS ASSOCIATION RULES OF CONDUCT.

NOT RESPONSIBLE FOR ITEMS LOST OR STOLEN. PLEASE AKE VALUABLES WITH YOU. LOCK DOORS AND SECURE WINDOWS. PLEASE HELP KEEP RATES AFFORDABLE BY CONSERVING UTILITIES. TREAT THE VILLAS WITH RESPECT.

1. A moderate speed of 30 miles and courteous driving must be observed.
2. Two persons per bedroom plus one is the maximum occupancy.
3. 6 people are allowed in the pool area per villa.
4. Fireworks are illegal in Mexico and forbidden. Security will ask you to leave.
5. Dogs are required to be on a leash under adult supervision and please be responsible for clean up.
6. Excessive noise after 10:00 pm and profanity is unacceptable.
7. Pools and tennis courts are located in each mission. Pool closes at 8:00 pm. Ask security for code if not provided by agent.
8. The BHOA General Manager must approve private pool parties in advance if more than 16 guests will be attending.
9. Children under 14 must be accompanied by an adult and obey all rules. Violators will be asked to leave. Security will ask for the address of your rental.
10. Tennis courts are not to be used for any other activities. Tennis shoes required.
11. Law prohibits alcoholic beverages on public streets.
